GENERAL INFORMATION
These Terms and Conditions set out the terms under which Users may use this website https://carousel.sisterjane.com, and under which Buyers and Sellers may buy and sell on Sister Jane Carousel. By using this website, selling your item(s) and/or placing your order you agree to be bound by the conditions set below. This site is provided by Sister Jane UK Limited. We are registered in England and Wales under company number 7529595 and we have our registered office at 36 Golborne Road, London W10 5PR. Our VAT number is 111854634.
We may change these terms and conditions from time to time without notice to you.
SISTER JANE CAROUSEL
The Sister Jane Carousel (“Carousel”) provides an online platform where users (“User(s)”) can list and sell items (“Items”). Users who purchase Items are referred to as “Buyers,” while those who sell Items are called “Sellers.”“Products” are items offered for resale by Sellers through the Carousel.
When using the Carousel, Buyers and Sellers enter into a contract for the sale and purchase of Products directly with each other, and Sister Jane Carousel is not a party to such sales or purchases.
There are risks inherent in dealing with others, and these risks are assumed by you alone, not by Carousel or Sister Jane. You are solely responsible for evaluating and deciding to use the Carousel, buy, sell, or engage in any transactions or communications on the Carousel, and you will be liable for all your actions on the Carousel.
TRANSACTIONS FOR BUYING AND SELLING
RISKS, NO WARRANTY
When using such as Carousel, you assume certain risks. Our Carousel and Sister Jane are not involved in, nor provide a warranty for, any transaction between Buyer and Seller, do not hold title to any Products, and are not the Buyer or Seller in any transaction. As a Buyer and/or Seller, you acknowledge, agree, and understand that you bear all risks associated with selling or purchasing Products on the Carousel.
PROHIBITED ITEMS
Sister Jane Carousel only allows the sale of Products purchased by Sister Jane customers on Sister Jane website. Certain product categories such as face masks, headbands, hair clips, hair ties, headscarfs or earrings, cannot be listed due to hygiene reasons.
SELLERS
You agree that you have all rights necessary to sell the Products you make available, and will describe such Items truthfully and accurately. Sellers at all times, respect the intellectual property rights of Our Carousel. Under no circumstances may you use intellectual property belonging to another party without that party’s express permission.
BUYERS
You are solely responsible for reading and reviewing the Product listing before making an offer or purchasing. The contract to purchase is between you (the Buyer) and the Seller, not Carousel or Sister Jane.
PURCHASES
Buyers may purchase Products from Sellers, creating a binding contract. Upon purchasing a Product, a Buyer must remit payment to Carousel, including any shipping or additional fees listed. Carousel is not an auctioneer, nor a Seller or carrier. The Carousel includes pricing, listing, and shipping assistance, but it is not a Buyer or Seller of Products. Carousel may delay any Purchase for fraud detection or to protect Users from illegal or wrongful activities. All Product purchases are final, with no returns, refunds, exchanges, cancellations, or retractions allowed, except where explicitly permitted by Carousel or where applicable, a Seller.
PAYMENTS
Buyers may pay for Products using payment methods approved by Carousel. Carousel will receive payment from the Buyer on behalf of the Seller. By submitting payment information to Carousel, you authorise Carousel to store that information and, with your confirmation, charge you for any Products purchased.
SHIPPING
Carousel provides Sellers with a prepaid shipping label to send the Item to the Buyer. (Carousel reserves the right to discontinue providing labels to any or all users at any time and for any reason). Sellers must ship Products within seven (7) days of receiving the label. If the Seller does not ship the Product, Carousel will cancel the order. Sellers must only use the provided label for the applicable item, are fully responsible for the parcel's contents, and must comply with all shipping carrier terms and conditions. Title transfers to the Buyer upon shipment. If there are issues with the order, the Buyer must report to Carousel within three (3) days of delivery. Once the Buyer confirms receipt and acceptance of the Product, either by affirmatively notifying Carousel or failing to notify Carousel within three (3) days of delivery (as determined by tracking information), Carousel will credit the Seller’s account with the purchase amount as Sister Jane store credit. Buyers are responsible for any shipping costs incurred for their purchased Product.
RETURNS
Unless otherwise provided herein, Carousel does not allow returns. If a Product is not as described on the Carousel, the Buyer must report the issue by emailing carousel@sisterjane.com within three (3) days of the delivery date based on tracking information. Carousel shall have the final determination regarding the accuracy of item descriptions and the sole authority to decide whether a refund is warranted. Buyer and Seller agree to abide by any final determinations made by Carousel regarding such issues and returns.
SOLE TRADERS
Private individuals who act as Sellers and that sell items regularly and/or that sell a large number of items may be qualified as sole trade by the tax or other authorities and may therefore be subject to the obligations that are applicable to sole traders by virtue of the applicable regulations and these Terms. It shall be the responsibility of such Sellers to comply with all their obligations, including making the requisite declarations to the relevant authorities so as to comply with the applicable regulatory provisions, and Carousel hereby disclaims any liability in this respect.
LAW AND JURISDICTION
Contracts for the purchase of Products through Carousel and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed exclusively by UK law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the courts of England and Wales.
WRITTEN COMMUNICATION
Applicable laws require that some of the information or communications should be in writing. When using the Carousel, Buyers and Sellers accept that communication with us will be mainly electronic. Carousel will contact Buyers and Sellers by e-mail or provide with information by posting notices on our website. For contractual purposes, Buyers and Sellers agree to this electronic means of communication and they acknowledge that all contracts, notices, information and other communications that Carousel provides electronically comply with any legal requirement that such communications be in writing. This condition does not affect statutory rights.
INTELLECTUAL PROPERTY AND CONTENT
Sister Jane owns or has permission to use the intellectual property rights in the Carousel and its content. These rights are protected around the world. All such rights are reserved. Buyers and Sellers are allowed to store, print and display website content only for personal use. Buyers and Sellers are not allowed to use any part of the website for commercial purposes unless they have express permission. Buyers and Sellers are not allowed to use the Carousel logo, Sister Jane logo or any Sister Jane, Ghospell, DREAM Sister Jane brand or affiliated trade mark without express permission. All the imagery on the website is subject to intellectual property rights and Buyers and Sellers are not allowed to copy, use, modify or distribute any of the imagery for any purpose save for reasonable personal use exclusively in the context of using website to evaluate a product for purchase.
ENTIRE AGREEMENT
These Terms and Conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing. We each acknowledge that, in entering into a Contract, neither of us has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior to such Contract except as expressly stated in these terms and conditions. Neither of us shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any Contract (unless such untrue statement was made fraudulently) and the other party's only remedy shall be for breach of contract as provided in these terms and conditions.
